The acquittal our team achieved for Robert Bogucki at trial before Judge Charles Breyer [of the U.S. District Court for the Northern District of California] is certainly one of my proudest recent achievements.
As Judge Breyer noted, he had never previously granted a Rule 29 motion in full before, but did so here after being persuaded that the prosecution was ill-considered and unjust.
In that motion, we were able to demonstrate that the conduct not only wasn’t “fraud,” it also did not violate corporate policies or industry practices.
Our whole trial team deserves real credit for that achievement.
Share two trial tips that have been key to your success.
1) As the late Barbara Babcock always said, “repetition is the sole of pedagogy.”
2) Develop your key trial themes and hammer them ahead of trial with the judge and repeatedly at trial with the jury. Keep it to just a few and don’t ever lose sight of them.
