When Judge [Richard] Leon expressed concern about approving the Tunney Act (antitrust) proposed final judgment related to the $69 billion CVS/Aetna merger, my team and I, working with Dechert, led multiple hearings and filings, including the first-ever Tunney Act hearing with live witnesses.
We responded to the concerns of the [U.S. District Court for the District of Columbia] and multiple amici. In September 2019, in a well-reasoned opinion, Judge Leon unconditionally approved the proposed final judgment. Earlier in the year, we secured another trial victory on behalf of CVS, this time winning a directed verdict in a Medicaid fraud case before closing statements to the jury.
Share two trial tips that have been key to your success.
1) Be comfortable letting your own personality through to the jury or fact finder. It will help you establish credibility.
2) Also helpful with credibility—don’t oversell your good facts and embrace your bad facts into your narrative so that you control the messaging.
